found that, on 05.03.2024 when surprise
cash verification in the ATM machine at Sagar Branch was
conducted, there was shortage of cash ... accused Nos.1 and 2, who
are the joint custodians of the cash in the ATM machine.
The bald reply was given by accused
respective banks. Accused No.1 was the custodian
No.1 of the said ATMs and he was having the code and
keys of the respective ... commission of the said offence being the custodian of
code and keys of said ATMs. The investigation as reflected
from the charge-sheet also discloses
into the ATMs (Automated Teller Machines) belonging
to the various Banks. They provide services for more
than 5,000 plus ATMs and the cash management ... ATMs, they
found shortage of cash in ATMs for a sum of
Rs.3,15,96,500/-. The petitioner was the custodian of
the cash
Bank. It is further alleged that out of six ATM's, three
ATM's cash was not handed over to the petitioner ... ATM, where digital
passwords were given to both. The accused No.1 and
the Manager if both of them go to ATM, then only ATM
cash for
depositing in ATM centres. CWs.10, 12, 13 and 14 were
the security personnel and custodian of the cash.
3. The case ... were on the duty of depositing the cash in ATM
centers of the bank. For that purpose, they were
carrying cash
filling up of ATMs with the currency Notes.
But without filling the ATM with the money obtained by
the Senior custodian, with the connivance ... Kishore.
The petitioner being the Senior custodian, he was also
required to adjust the money in the ATMs and between
ATMs, in which much demand
