regularized/ compounded the alleged deviations.
16. According
to the Appellants, there are no non compoundable deviations/additions in the
building as the other portions/ floors ... compoundable deviations. There is no order of MCD in which they have
regularized the non-compoundable deviations in the construction of the building
which
appellants opted for cancellation of Development Agreement, proceeded to
construct the building deviating from the original plan and the nature of
utility of the building
failed to keep their promise. On the contrary, developer has deviated the sanctioned building plan for which the complainant approached the Consumer Affairs Department, Government ... such a situation, it is palpably clear that there was deviation in the sanctioned building plan and in their written version
opposite parties constructed a G+5 storied building in place of G+4 storied building as per terms of Agreement for Sale and thereby diminished ... caused illegal construction of one extra floor in respect of the building deviating from the original plan of G+4 storied building.
