addition to his above submissions Mr.
Nariman submitted that after the chargesheet
was filed by the CBI on 30.12.1998, no
further steps have been taken ... Bank had not taken
any action against its employees against
whom chargesheet had been filed. He urged
that from the manner in which the entire
Special Court, CBI cases,
Mumbai with a prayer to forward the chargesheet to the learned
Magistrate who was competent to take cognizance of the offences ... investigation. As the facts would undrape, on 3.2.2006
upon perusal of the chargesheet the learned Special Judge, CBI cases
directed to place the chargesheet before
completed. On the day judgment was pronounced by the High
Court, the chargesheets were filed in the Court of Special Judge.
After the filing ... said chargesheets, the appellants have also
filed Writ Petition (Criminal) No. 135 of 2017 in this Court seeking
quashing of these chargesheets. Both these proceedings
read with Sections 406 and 420 thereof wherein
the CBI filed a chargesheet. Later on, however, some subsequent events
emerged resulting in lodging ... validity of
the first FIR was in question. In that case, another chargesheet was filed on
31.03.2000. This Court held:
"11. Learned counsel adopted
stood assaulted.
Disciplinary proceedings were initiated against the delinquent by
issuing a chargesheet dated 26.7.1991. After the conclusion of the
proceedings, the inquiry officer submitted ... delinquent, there was no occasion for the appellants to
issue a fresh chargesheet. The chargesheet had been issued by the
CMD, ECL, but the High

the matter till the investigation was completed and the
chargesheets were filed in the competent court for being
