letter intimating closure is being filed alongwith the present petition. The
said closure was also ... intimation has to be
made to the regional office itself. However, the Act nowhere prescribes
any procedure or proforma in which intimation of closure
recored with the respondent with respect of conveying the intimation of
closure by the petitioner. The petitioner was required to comply with the
ESIC ... respondent, on the other
hand, has submitted that the intimation of closure ought to have been
made to the head office or the regional office
further stated that the
applicant's letter dated 25.10.2010 intimating temporary closure of the petitioner's
firm is not on records of office ... Mark B,
intimation regarding reopening of the establishment w.e.f 20.02.2014 as Mark C,
intimation regarding temporary closure of the establishment
date of closure i.e. 31.07.1995. It is stated that
intimation of closure was sent to the respondent.
2.4 Despite receiving the intimation of closure ... intimation has been sent
as per the provisions, which implies that whether all the required
documents for proper intimation of the closure were sent
staff canteen and firm Kumar Caterers was
also dissolved and due intimation of closure of the firm was given
to the respondent and thereafter ... since
15.09.1996.
3.2. It was specifically denied that any intimation of closure of the
unit was given by the petitioner to the respondent under ESIC
sent an e-mail dated
20.03.2020 through its Authorized Representative intimating
closure of their outlet ' Choco La' and their inability to pay rent
