3. The respondent workman was working as Swimming
Coach since March 1996 receiving last month

Swimming Coach. Since the criminal prosecution was instituted
against Mr. Laliwala, the post of Swimming Coach fell vacant.

2. Learned counsel for the applicant has
submitted that earlier service of the applicant
was terminated and the matter regarding

permit the petitioner to
join the service as Athletic Coach with the department with immediate
effect and further direct the respondent no.2 to consider ... direct the respondent no.2 not to pass any specific order of terminating
the service of the petitioner.
