the High Court was in error in foisting the liability ... possession

Since the Second respondent was in control and possession of the vehicle
this Court held
Devi v. State of Assam and other11 that has dealt
with the definition of the term “owner” as contained ... Assam Act . Therefore,
Respondent 1 was squarely covered under
the definition of ‘owner’ as contained in
