have been
exchanged with the land of the builders. Some portion of the land of the
Gram Panchayat exchanged with the builders is almost surrounded ... exchanged land was agricultural land now a
developed land.
2. There was 24 meter road of Gram Panchayat land
whereas, the present exchanged land touches
purpose of the village, whereas the private land is
cultivable land abutting to the other Panchayat land and it can
be leased ... necessary". Factors like more valuable land, a large piece
of land, better location, quality of land, are merely enabling factors
which in the absence
land so exchanged was admittedly not mortgaged in favour of the HUDCO.
Further contention of the petitioner is that the exchanged land of about ... exercise jurisdiction over the land, and hence, is the appropriate authority to demarcate the land and identify 21 acres of land which is not mortgaged
main objection to this exchange of
land is that he has his agricultural land adjoining the land
where the Gram Panchayat ... this exchange
of land appears to be need based and justified."
It was noticed that the land taken in exchange, is suitable for
discharge
land of
respondent no. 1 herein in the garb of 10 biswas of land which was
exchanged as stated above.
Accordingly, the appellant has filed ... wrong to suggest
that the exchange deed was registered in favour of the defendant in
respect of exchange of land. On the contrary
acquires interest in land by testamentary disposition or devolution on death; (i) “transfer” in relation to land means the transfer of land belonging ... other Tribal subject to certain restrictions.
(1) Where any land (not being land acquired in exchange), which is liable to be restored to a Tribal
transfer— (a) The land of a Tribal-transferor is held by a non-Tribal-transferee, or (b) the land acquired in exchange by a Tribal ... land for a public purpose, then only half the land so transferred shall be restored to the Tribal-transferor. Explanation.—Where the land

3) Warjit Singh-plaintiff had challenged ... exchange of land. The
above arguments of the learned counsel for the appellant is without any
substance. The land given in an exchange
respondents 1 and 2 are not entitled to get compensation or exchange of lands.
(g) The above said order was challenged by the respondents ... having failed to get partition of their share, cannot demand compensation/exchange of land as the entire area is now occupied by the trespassers
