instructions cannot override the definition of pay as contained in
FR 9(21)(a) of the Fundamental Rules and at best, it could only ... adjusting
the pay in the pay band upwards in conformity with FR 9(21)(a) of the
Fundamental Rules. Aggrieved thereby, the present writ petition
member of the force is treated as duty under FR(9) (6) (b) (i).
FR 9 (6) (b) (i) reads as under:-
"FR.9 ... Central Reserve Police Force
Rules, 1955, and FR 9 (6) (b) (i), would show that period spent on
training also would amounts to duty. This

increment as per Rule 9 of FR 22-B, while fixing the pay of the petitioner in the
promoted post ... Ruling 9 is an extended version of FR 22-
B. Therefore, reading FR 22-B and Ruling 9 harmoniously, the conclusion arrived
services were regularized, their retirement age is not indicated, as per FR.9, their service must be treated as basic service.

allowance already paid, if there is no rule otherwise.
9. Sub-rule (9) of FR 54(B) relates to payment of salary for the period ... compulsorily retired from service.
10. As per the aforesaid Sub-rule (9) of FR 54 (B), the petitioner having been acquitted, even if by giving
Service Rules are to be read
with in consonance with Fundamental Rule 9(6)(b), 18(1) to (4) and
85(1) and (2) therein ... cannot be termed to be duty for three years, as per FR 9
(6)(b) read with 5 (b) of Old Madras High Court Service
subsequent to the regular posting.
8.It was further stated that FR 9(6)(b)(2) clear states that the period of training will
