POCSO, rejecting the de facto
complainant's application to accept Facebook messages sent by
the accused either to the victim or her parents under ... complainant,
stating, inter alia, that the accused himself confessed in his
Facebook messages that he had indulged in sexual intercourse
with the prosecutrix while
further alleged that
the appellant has also send abusive and obscene message on
facebook.
Learned counsel appearing on behalf of the appellant
submits that ... completely denied the allegation of sending any obscene and
abusive message on facebook. The appellant is in custody since
18.12.2021 and moreover, investigation is completed
name and photograph and used to send obscene
and wrong message on the said facebook account.

3. As per FIR, the petitioner posted a message on his
Facebook Account containing the message as mentioned in the
FIR precisely putting ... allegation has
been made that the said message has been posted by the
petitioner's Facebook account, which is an objectionable and
provocative.

4. Learned counsel for the petitioner submits that the
petitioner has clean
further stated that the petitioner continued posting unsocial
messages of facebook and social media about them and he also
used to send vulgar messages from

that any negative message has been sent from the face book account of
petitioner to the facebook ... been filed merely on suspicion that
some people are sending message on facebook account to create
communal disharmony.

pertaining to Hindu God and Goddess received on his Facebook
I.D. from Kalwar Samaj Sangathan ... case. As a
