of evidence and so also destruction of documents, forgery
and making false documents for the purpose of
misappropriation
Civil Court has
given its finding with regard to the forgery of the
document without any basis ... However, forgery is an
offence as contemplated under Indian Penal Code .

When specific allegations are made with regard to
forgery of documents, the same
instrument in a cheque is neither forgery nor the
instrument be called as a forged document. The said
insertion of the date in the cheque ... read as below:
"468. Forgery for purpose of cheating.-
Whoever commits forgery, intending that the
document or electronic record forged shall
punishable under Section
498A but has also involved in tampering the document

produced before this Court is a genuine document. The
petitioner is not instrumental ... committing the alleged

MACT and therefore, there cannot be any apprehension
of the petitioner tampering with
