applicant submitted a representation to respondent No.2 on
10.09.2013 with a request of upgrade the APAR to outstanding or
to very good ... Good'. No reasons have been assigned by respondent No.3 for
downgrading the assessment from 'Very Good' to 'Good' contrary
Good‟ while the Accepting Officer
downgraded it to „Good‟. Earlier, he filed O.A No. 50/2018
praying for upgradation of the said APAR ... Therefore the
Accepting Authority using these letters to treat these APARs
as „Good‟, is not justified.
5. The applicant has prayed that order dated
Railways
has issued Memorandum dated 23.05.2019, directing
that the APAR, graded as 'Good' for the period anterior to
25.07.2016, shall be treated ... assessed as 'Good' for the period prior to
25.07.2016as 'Very Good'. The result is that, the APAR
of the applicant
Annual Performance Appraisal Report („APAR‟) for the year 2016-17, but
maintaining the overall grading as „good‟ for the period from 1st April to 11th ... Petitioner‟s gradings
in his APARs since 2013-14 have been consistent: Either outstanding
or very good. In this context, the observations of this Court
officer consistently assessed as "Outstanding"
or "Very Good" becomes "Good" or "Average" in one or two years ... have downgraded the
petitioner to the grading of "Good" in the APAR of the petitioner for the
period 1st April, 2018 to 31st
