public advertisement issued by
the Gujarat Public Service Commission ("GPSC")
for the post of Assistant Charity Commissioner
(ClassI), the petitioner, being qualified ... selected through
the competitive written examination and oral
interview. The GPSC recommended the name of the
petitioner by letter dated 16.10.2001, for the
said post
kept in waiting list against the Sr. No.19. The GPSC has
recommended only 67 candidates including ... number of vacancies under different categories
and selection made accordingly. The GPSC recommended for only selected 67
candidates and they were appointed by the Government
GPSC on 13.07.2007, seeking its advise. The GPSC, vide
communication dated 16.04.2008, did not agree with the
proposed punishment and recommended the penalty of
dismissal ... State Government did not forward a copy of
the recommendation of the GPSC to the petitioner before
passing the order of dismissal. Neither
after
consultation with the GPSC and a copy of the
recommendation of the GPSC in this regard has not been
supplied to the petitioner ... penalty of dismissal from service as
per the said recommendation of the GPSC. The petitioner
has been deprived of an opportunity of representing his
case
petitioner for consultation to
GPSC vide letter dated 14.5.2012.
14. It is respectfully submitted that GPSC has recommended to impose
major punishment of reduction ... from pension for a period
of five years, whereas the GPSC, upon consultation recommended deduction of
Rs. 3,000 for a period of eight years
GPSC on 13.07.2007, seeking its advise. The GPSC, vide
communication dated 16.04.2008, did not agree with the
proposed punishment and recommended the penalty of
dismissal ... State Government did not forward a copy of
the recommendation of the GPSC to the petitioner before
passing the order of dismissal. Neither
aspect,
namely, that before the implementation of the
recommendation of the GPSC and passing the final order
of penalty against the petitioner ... respondentState Government to
forward a copy of the advise/recommendation of the GPSC
to the petitioner and afford him an opportunity of
hearing
period
between 24.11.1987 to 22.11.1995 i.e. period prior to passing of GPSC
examination, as per the directions issued by this Hon'ble Court ... clearing the GPSC
examination by the petitioner. Learned advocate Mr. Majmudar submitted
that the case of the petitioner was recommended by the higher authority
appointments are required to be made out
of the recommendation as will be made by GPSC.
