having applied under the Kerala
Land Utilisation Order, 1967 (for brevity "KLU Order") also directed
that the authority shall consider first whether ... consider the application under that Act and
otherwise, under the KLU Order.
2. In compliance of Exhibit P6 series of judgments,

permitting conversion, under the Kerala Land Utilisation Order, 1967
(for brevity "KLU Order") only for construction of a residential house for
the owner ... have declined the
permission sought for under Clause 6 of the KLU Order. The Circular,
it is argued, cannot fetter the discretion conferred
aside as they are in contravention of provisions of KLU
Order, 1967 and Kerala Conservation of Paddy and Wetland Act, 2008 .
7. Per contra, learned ... Department has issued
instructions to follow the modalities for implementation of the KLU Order,
wherein conversion for construction of houses for individuals are permitted

under Rule 6(2) of the KLU order, 1967 for conversion of the subject
