whether the sale in their favour is hit by the doctrine of
lispendens. It returned a finding that the said defendant-appellants have
purchased ... present suit, it was held to be hit
by the doctrine of lispendens. Consequently, the plea of bona-fide purchaser
without notice is not available
defendants during the pendency of the suit, is subject to doctrine of
lispendens. Therefore, any alienation effected by the defendants will
not affect the rights
parties
as such sale is subject to doctine of lispendens.
In view of the above, I do not find any patent illegality or
material irregularity
possibly convey any title in favour of
the appellant. The doctrine of lispendens does not require the notice of the
pending litigation to the prospective
dismissed by observing that subsequent
purchaser is hit by the doctrine of lispendens and the purchaser shall
be bound by any judgment qua the suit
