Upgradation of the applicant-respondent herein ignoring
the Annual Confidential Reports ... order on the relevant file in regard to
the non-granting of non-functional upgradation. The
case of two employees junior to him who were

of Expenditure, who have clarified the matter as follows:-
"....Non-functional upgradation to the grade ... under ACP will not be entitled to the benefit of
further non-functional upgradation to the pre-revised pay scale
against which the applicant was holding his post. For consideration
of non-functional upgradation, the mandatory requirement is to
have a regular service ... under ACP would not
be entitled to the benefit of further non-functional upgradation
to the pre-revised pay-scale
against which the applicant was holding his post. For consideration
of non-functional upgradation, the mandatory requirement is to

official car. Therefore, the officers,
who have been granted non-functional upgradation to the Grade Pay of
`10000/- in Pay Band ... official car. In the present case, the applicant has been
granted non-functional upgradation to the Grade Pay of `10000/- in Pay
Band
dated 24.04.2009 (Annexure A-5), which provides for grant of
non-functional upgradation for officers of Organized Group 'A' Services in
Pay Band ... order reads as under:-

that they may have been granted non-functional upgradation to the next
higher grade pay of `10000/- would be entitled
