under Chhattisgarh Prisoner's Leave Rule,
1989 (henceforth " the Rule, 1989") for grant of leave/parole has been
rejected.

then their life may be in danger and on that basis, Superintendent of Police
also opined not to grant leave/parole
issued to the respondent authorities to release the petitioner on
subsequent leave/parole under the Chhattisgarh Prisoner's
Leave Rules, 1989.

7. As per learned counsel for the petitioner, after availing last
leave/parole, the petitioner was admitted
Shaikh Abdul Gaffur i.e. Convict
No. C-5345 on emergency parole leave as per Notifcation
dated 08.05.2020, by quashing the order dated 15.12.2021,
passed ... petitioner that her husband is entitled for
release on emergency parole leave, as mentioned above.

appears that at present, the petitioner is on parole
leave for 60 days starting from 3.6.2022 granted by the Apex
Court vide its order dated ... that by showing false health reasons, his
father is now on parole leave and while on parole leave, his
father is harassing him and threatening
Rule 1989, she had applied for
grant of leave/ parole which was dismissed by the Competent
Authority without any application of mind and only ... Constitution.
14. In the instant case, application for grant of leave/parole filed by the
petitioner has been dismissed only on the ground that Police
authorities are not
permitting him to file application for grant of leave/ parole, therefore, this
petition may be disposed of directing respondent / authorities to allow ... detainee / respondent No.4 to file application for grant of leave / parole as
per provisions of Prisoner's Act, 1900 and the Chhattisgarh Prisoner
this application, the applicant seeks for being released on
parole leave more particularly to attend the marriage ceremony of his son.
4. Jail remarks show ... submit that in case if this Court were inclined to grant parole leave to
the present applicant then the same may be with police escort
