Patiala. As per report of Chemical
Examiner, death was due to Aluminium Phosphide. After endorsement at
12.30 PM, statement was sent to the police station ... report of
Chemical Examiner, cause of death was due to aluminium phosphide and
injuries to vital organs. Injuries were ante mortem in nature and sufficient
that after chemical analysis of viscera, it showed positive
results of aluminium phosphide in stomach wash, stomach and piece
of small intestine while the pieces ... kidney and blood
sample of deceased gave positive results for presence of phosphide.
MEDICAL WITNESSES:
4B(i) PW22 is the lady Dr. Karuna Prasad, Resident
that only on the basis of the fact that ''Aluminium Phosphide' has been found in her viscera report, it cannot be assumed ... viscera report itself reveals that the poison ''Aluminium Phosphide' was found during its examination, which is evident from the report

presence of aluminium phosphide (although there was/were no
sign of consumption of aluminium phosphide in the dead body ... asphyxia

Charges framed
6. The Appellant was arrested on 12th April
viscera of the deceased tested positive for presence of
aluminium phosphide i.e. aluminium phosphide was detected
in the stomach and a piece of small ... intestine. From the pieces
of liver, spleen and kidney of the deceased phosphide was
detected.
18. Reverting back to what happened on 20.7.2002,
after
that is stomach, small and large intestines, liver,
lung and kidney aluminum phosphide was detected, that does not prove
the fact that Sunita was subjected ... administration of aluminum phosphide.
13. DW-2 Bimla, neighbour has also stated that deceased Sunita
had fit of epilepsy.

PW12 opined that the cause
of death was poisoning due to aluminum phosphide. Postmortem report
is Ex.PW12/A.
