CONSIDERATION ON MERITS
28. Prefatory note:
(A) Facts have not been put in a straight manner
this suit, on
27.04.2016, I find it necessary to make few prefatory observations qua this suit as
well as the previous two suits filed ... same cause
of action.
25. In the wake of the aforesaid prefatory observations qua qua this suit
as well as the previous two suits filed
invocation of criminal law.
17 The narration of facts in the prefatory part of the judgement would indicate
that FIR No 172/2022 which
involved is a statutory contract or not, we may
make the following prefatory remarks:
Under Article 298 of the Constitution, the
Executive Power
very core of liberty, is
freedom from unjustifiable custody.
With these prefatory remarks, we may pass on to consider
the complaint of the petitioners
exercise power under Article 142. We
record this submission for as a prefatory remark to
indicate that this is not a case where both parties
same could not have been considered
by the High Court. With this prefatory clarification,
