2. The petitioner's case succinctly is thus:
(a) The Quartz lease over an extent of 35.101 Hect ... filed counter opposing the writ petition as
follows:
(a) Originally the Quartz lease over an extent of 35.101 Hect. in
Sy.No.2117 of Talapula
petitioner submitted an application for grant of mining lease
for Quartz mineral over an extent of Ac.12.00 cents (4.85 hectares ... mining lease
since the area is covered with vast extent of quartz mineral. Since the
respondents 6 & 7 have applied for mining lease, their
lease was
granted in favour of M/s.Benita
Industries limited for quartz quarry
mining in Sy.No.114(P) of
S.Brahmanapalli Village ... procedure as
contemplated under MMDR Act and
before the grant of quartz quarry mining
lease, environmental clearance was also
obtained. Once the Industries obtained
Minor Minerals as per G.O.Ms.No.34,
dated 14.03.2016. Accordingly, quartz is a Minor Mineral and at
present registration of quartz
recommended to the 3rd
respondent for grant of mining lease for Mica, Quartz and Feldspar.
(b) In turn, the 3rd respondent without verification and conducting ... respondent filed two applications for grant of quarry lease
for Mica, Quartz and Feldspar over an extent of Ac.6.84 Cents
granting in-principle
environmental clearance for mining of Mica, Feldspar and
Quartz in an area of 3.791 Hectares in favour of the petitioner ... clearance in
favour of the petitioner for mining of Mica, Feldspar and
Quartz in an area of 3.791 Hectares in favour of the petitioner
ORDER:
The 6th respondent had been granted a quarry lease for Mica,
Quartz & Feldspar to an extent of 4.937 hectares
Mines and Minerals'
and submitted quarry lease application on 05.11.2019 for Quartz over
an extent of admeasuring 18.000 Hectors in Survey
ORDER:
The petitioner had applied for grant of mining lease
for Mica, Quartz and Fledspar in an extent of 16.14 hectares of
land
