Refusal of passports, travel documents, etc.--
(1) Subject to the other provisions of this Act, the passport
authority shall refuse to make an endorsement ... Passports Act includes 'renewal' of the passport as

7. Section 6(2)(f) of the Act mandates refusal of
passport if proceedings in respect of an offence alleged to
have been committed
WHEREBY THE RENEWAL OF THE PETITIONER'S PASSPORT HAS BEEN
REFUSED, THE SAME BEING ILLEGAL, ARBITRARY,
UNCONSTITUTIONAL AND VIOLATIVE OF ARTICLES ... Annexure-D whereby the
renewal of the petitioner's passport has been
refused, the same being illegal, arbitrary,
unconstitutional and violative of Articles

respondent [the Regional Passport Authority] to
withdraw objections and issue passport. The second
respondent has refused to issue passport because of
the pending criminal ... therefore, there
is no justification for the second respondent to refuse
to issue passport to the petitioner. The learned
counsel proposes to rely upon certain
Passport's Act, 1967 (for short 'Act, 1967') empowers the
Passport Authority to refuse issuance of a passport where

6. In view of the aforesaid, the Passport Authority
9594/2025 (Annexure-J), while dealing with an identical
question concerning refusal of passport on the ground of
pendency of criminal proceedings, has categorically held ... invoking Section 6(2)(f) of the Passports Act, 1967.
Consequently, the action of the respondents in refusing to
process the petitioner's application
