mangalsutra and ear-rings at his instance. The prosecution has
examined PW 10 Raju ... memorandum of
recovery panchanama Exhibit 52 and the recovery panchanama
Exhibit 52A for the recovery of mangalsutra and the ear-rings. PW

case
is based on the circumstantial evidence. Except the recovery of the said
gold ring and the cash amount, there is absolutely no material ... reveals that except
the circumstance of recovery of the amount and recovery of the gold ring
there is no other material to show that
complicity in the offence.
There is only vague evidence of recovery of ear ring. On that
basis it is difficult to conclude that the Applicant ... Applicant. The
only material which needs serious consideration is about
recovery of ear ring. That memorandum panchnama was
recorded on 25.10.2019 and the Applicant
Simplex company, golden
ring with red stone, another ring with green stone,
one golden chain, a gold ring and silver ring.
Similarly the live cartridges ... were also recovered.
This recovery of ornaments from accused No.2 on the
spot and identification of the ornaments by Mira
four gold beads, one gold
Pendant and gold Ear-rings (Karnafule) total 32.250 gms. Recovery
panchanama was accordingly drawn by Investigating Officer in
