Constitutional Provision Regarding Reservation.
The framers of the Constitution envisaged the affirmative
action in the form of providing reservation to backward
classes. Clauses ... members of the Scheduled Castes and
Backward Classes (14% for the Scheduled Casts and 2% for
the Backward Classes) subject to the conditions that
reads as follows:
"9. HORIZONTALITY OF RESERVATION FOR PERSONS WITH
BENCHMARK DISABILITIES:

exclusion of the creamy layer for the purpose ... 36012/22/93-

Backward Classes inthe services and posts under the
Government of India. The format
made in favour of a Backward Class under Article 16(4) ,
the candidates belonging to such Backward Class, may compete for non-
reserved posts ... Tribes and Other Backward Classes, respectively;
provided that if a Scheduled Caste or the Scheduled Tribe or the Other
Backward Class ex-serviceman is selected

incidental thereto.
