Section 503 in The Assam Excise Rules, 2016
503. Establishments and their cost.
- The State Government or Commissioner of Excise shall appoint such officer
falls within the definition of criminal
intimidation as defined under Section 503 IPC and as such trial court
should have framed the charge accordingly ... Material perused.
Before proceeding ahead here it is necessary to reproduce
Section 503 and 506 of IPC, which are as under :
Section 503 . Criminal Intimidation
under Section 503 I.P.C and Section 506 I.P.C provides
punishment for it.
Section 503 reads as under:
"Whoever threatens another ... whom the persons threatened is interested, is within this
section.
An offence under Section 503 has following essentials:
1. Threatening a person with any injury
with certain amount of
circumspection and with utmost care and caution.
Section 503 of the Indian Penal Code defines
criminal intimidation as follows:-
"Whoever ... threatened is interested, is within
this section."
17. If we carefully go through the
provisions of Section 503 of the Indian Penal
Code
under
Section 503 I.P.C and Section 506 I.P.C provides
punishment for it.
Section 503 reads as under:
"Whoever threatens another ... whom the persons
threatened is interested, is within this section.
An offence under Section 503 has following
essentials:
1. Threatening a person with any injury
Section must be proved beyond reasonable doubt. In the instant
case, the appellant cannot be convicted for the offence of cheating
punishable under Section ... reasonable doubt.
22. Further, Section 506 of IPC prescribes punishment for the offence of
criminal intimidation as defined under Section 503 of IPC. Section 503
under Section 376
IPC) and within the mischief of the offence of penetrative sexual
assault as defined in Section 3 , ordinarily punishable under Section ... criminal intimidation within the meaning of
the expression defined in Section 503 IPC, punishable under second
part of Section 506 IPC, thereby bringing home
prima facie, disclose the commission of the offence under Section 506 /
323 / 341 IPC. Section 506 IPC prescribes punishment for criminal
intimidation which reads ... both."
21. The offence of criminal intimidation is defined in Section 503 IPC.
Section 503 IPC reads as follows:
"503. Criminal intimidation.--Whoever
conviction under Section 504 PC."
Considering the fact of the present case, in wake of the aforesaid interpretation of Section ... summoned is Section 506 of I.P.C. which provides for punishment for criminal intimidation. The criminal intimidation is defined under Section 503
