School defines a Secondary School
as a School which provides a course in general education
leading to the Secondary School Certificate examination ... School by definition, is a Secondary School. The School
is recognised by the Government. Therefore, the affairs
of the School must conform to the Code
school, cannot be ground to refuse to
correct the school record. It is submitted that,
Rule 26.3 of the Secondary School Code cannot be

record, as permissible under the provisions of
Rule 26.4 of the Secondary School Code and after
following procedure in Appendix
power vested in the school authorities to correct the mistakes. Clause 26.4 of the Secondary School Code reads as below:
26.4 Application for change ... case, obviously for effecting change in the school register, no procedure, as laid down in Secondary School Code, was followed, nor there was any apparent

submitted that as per Secondary School Code,

correct the same as per the Secondary School Code.

5. Appendix Six of the Secondary Schools
Code, 2006 lays down the procedure in respect ... school authorities and which has
been forwarded to the Education Officer (Primary),
Zilla Parishad, Osmanabad, in accordance with
provisions of Secondary Schools Code
birth is not permissible in view of Rule 26.3 of the Secondary
Schools Code.
10. We have heard learned Counsel for the petitioner ... misinterpreted
the provisions of Rule 26.3 of the Secondary School Code.
13. Bare look at Annexure-A, which is birth certificate of the
petitioner indicates
ground is that relevant entry was made in 1955.
Whereas, the Secondary School Code was enacted and given effect
from 1963. The reliance placed ... that in the year 1955 when
this entry was corrected the Secondary School Code was not in
existence. It is submitted that applying the provisions
Education Officer (Secondary). By communication dated 2 June
2025, the proposal was rejected on the ground that the Secondary
School Code/School Code of Conduct ... respondents rejected the petitioners' representation by
placing reliance upon the Secondary School Code and by asserting that
