The learned Judge was prepared to hold that even in the absence of a physical structural defect
storey and of one of the rooms below was not any structural defect in the building itself but the fact that a neighbouring building fell
cannot be brushed aside that if there is a structural defect in Cheque, an offence under Section 138 of the Negotiable Instruments
page 112, says:--
"The presence of a physical structural defect is not essential. The statement by Lord Penzance to the contrary ... basis of the court's interference is not the structural defect, but the impracticability of consummation".
