Central Railway had applied for the post of Traffic Apprentice. The mode of
selection consists of written examination and perusal of records ... placed on the
panel for the formation to the post of Traffic Apprentice. The applicant had
undergone initial training in phase-I (Guards), Phase

respondent No.4 appeared for the post of Traffic Apprentice but was
found medically unfit in the said category but he was given ... could not been
appointment. Respondent No.4 was appointed as Traffic Apprentice
but after declaring him unfit he was taken as Commercial Inspector
to that

inviting option for the post of Traffic Apprentice in the scale of
5500-9000/- against 10% quota through LDCE from all Group ... directed by respondent No.4 to release
applicant for joining as Traffic Apprentice w.e.f. 11.04.2010.
Applicant was released to join for the training
standby list for the posts i.e.
Commercial Apprentice and Traffic Apprentice (having GP of Rs
4200/). With up-gradation of GP for the post ... standby list will be maintained for the post of Commercial
Apprentice/Traffic Apprentice."
6. The petitioners sought to submit, before the Tribunal, that
Clause
were selected for appointment against the
posts of Traffic Apprentices, vide the select dated 03.08.2005, were thereafter,
deputed for training at the Zonal Railway Training ... said Original Application had contended that
they had joined as Traffic Apprentices in the year 2008 itself; and thereafter, were sent
for training. The posts
maintained only
in respect of the post of commercial apprentice and traffic apprentice.
Clause 1.07.02 read thus:
"1.07.02 Once a candidate has been empanelled ... standby list will be maintained for the post of Commercial
Apprentice/Traffic Apprentice."
3. Ms. Chugh has drawn our attention to Clause
Under the extant norms, the
applicant was initially appointed as Traffic Apprentice in the scale of
Rs.5500-9000 (5th CPC ) for a period ... training, the applicant would be eligible for
absorption as a Traffic Apprentice, to the extent vacancies are available,
either in the Chennai Division
