Adhoc Rules under Article 309 of the
Constitution ceased to operative once those adhoc rules were
framed and that under Adhoc Rule 13 the seniority ... Graduates.
Now Rule 13 dealing with seniority of junior Lecturers
reads as follows:-
13. Seniority: (1) The seniority of a person
appointed under clause

(4) Seniority of Adhoc Employees.-(a)
A person appointed on adhoc basis shall
not get any seniority till the regularization
of his services
said G.O unequivocally stated
that the interse seniority of the adhoc appointees would be fixed
following the rotations prescribed in the above said Special ... adhoc/temporary appointments were made
and they have also admitted that no adhoc/temporary employee would
be placed above the direct recruits and the seniority
adhoc Lecturers between 1979 to 1986 and
regularized in year 1995, later confirmed in the year 1996. Claim;
counting of adhoc service towards seniority ... respective replies to the writ
petitions. Claim for counting the adhoc service towards seniority has
been strongly contested, inter alia, on the ground that petitioners

FOR SENIORITY AND SERVICE BENEFITS:
6(i). While dealing with the claim for seniority
for adhoc or stop-gap service service ... appointment is adhoc and made 'according to Rules'
then only, such continuous adhoc service upon
regularization, shall count for seniority whereas,
in case
ENCs respectively purely on adhoc basis by
taking into consideration the adhoc seniority list of DyEEs
prepared by respondent No.2 subject to outcome ... dated 29.09.2022, and now it is proposed to revise the
adhoc seniority list prepared by respondent No.2 in accordance
with Rules
eligibility (academic qualifications, experience and age) at
the time of his first adhoc/temporary appointment.
(3) He must have been recruited through the Employment
Exchange ... regularisation by the
Departmental Selection Committee.
(8) Among the persons regularised, interse seniority
would be observed. All these persons would be placed junior
to those
their names not being mentioned in that
seniority list. Therefore, there is no need to quash the
seniority list dated ... date until which
time the Current Duty Charge holder and Adhoc appointees
according to seniority will continue to man the remaining
posts. Respondent I shall
