aforesaid interrogatories raised by the respondent.
6. The response of the petitioners to the various interrogatories
were as under:
―1. In answer to Interrogatory ... Where any party fails to comply with any order
to answer interrogatories, or for discovery or inspection
of documents, he shall, if a plaintiff
Order 11 Rule 21 for non-
compliance with an order to answer interrogatories, or
for discovery or inspection of documents.
(d) Dismissal under Order
Court may deliver the interrogatories". Leave to deliver interrogatories
is, therefore, a matter of the discretion for the Court. Interrogatories
may be delivered ... which reads thus:
"6. Objections to interrogatories by answer.-- Any
objection to answering any interrogatory on the ground that it
is scandalous or irrelevant
court under
Order 10 Rule 1 of the Code;
(iii) in answers to interrogatories under Order 11
Rule 8 of the Code;
(iv) in response
interrogatories when
delivered shall have a note at the foot thereof stating which of
such interrogatories each of such person is required to answer:
Provided ... answer the interrogatories once leave to serve the
interrogatories is granted by the Court, with the observation,
that the interrogatories relate to the matters
becomes an effective date, as also, the replies
to interrogatories contained in IA No. 12886 of 2019, and
produce the documents listed ... documents
sought vide IA No. 8270 of 2019, and to answer the
interrogatories sought to be answered by the petitioner (vide
prayer for responses on Interrogatories 1 and 2 and restricts his
prayer to Interrogatory 3.
3. On Interrogatory 3, Mr. Pravin Anand, learned Counsel ... offending products from its platform,
the needful was done. Interrogatory 3 stands answered in the
aforesaid terms.
4. As such, this application stands disposed
permissible in
contempt proceedings. Contempt proceedings cannot be
likened to proceedings inviting interrogatories.
20 Tested on the above touchstone, it is clear that the application ... make out any case for issuance of
notice, to the respondents, to answer the allegation of having
committed civil contempt of this Court. There
