3. The brief facts leading to filing of the present petition
been filed by the petitioner, challenging
his Annual Performance Appraisal Report ("APAR") for the
assessment period 21.06.2015 to 31.03.2016, which grades the
petitioner ... passed by the respondent no.5 rejecting
his representation against the Impugned APAR.
2. It is the case of the petitioner that the petitioner joined
Benchmark
grading endorsed in his Annual Performance Appraisal Reports
(in short, 'APAR') for the years 2021-22. The petitioner further
prays ... writ of mandamus directing the respondents to
upgrade his APAR for the years 2021-22 with all consequential
benefits.
Case of the Petitioner
further submits that the respondents had asserted that the
ACRs/APARs of the petitioner were available only till 2011-12 and
were not available ... because the respondents, for their own
reasons, did not write the ACRs/APARs of the petitioner, the
petitioner cannot be penalized.

"5. Accordingly, we unhesitatingly allow the
present Original Application. The APAR of the
applicant of the year 2012-13 is quashed ... While allowing
this Original Application, we would like to
emphasise that the APAR of the applicant of
the year 2012-13 shall stand expunged
colleagues of same
cadre and batch.
(iii) To quash the APAR for the period 1.04.2014 to
