these rules, no preference was given
to the trained apprenticeship. Even the advertisement did not
indicate any preference to the trained apprentices. Learned senior
counsel ... preferred to the younger. Therefore, it is evident that
consciously the State had not provided for any preference to be
given to the trained apprentices
vacancies for apprentice trainees."

In the said
other things being equal, the trained apprentices
should be given preference upon direct apprentices. This
judgment does not help the appellants at all. What ... that if the non-Railway trained apprentice is
equal to the Railways trained apprentice on merit, then
preference can be given to the Railways trained
apprentices governed by the Apprentices Act, 1961 . The relevant principles are as follows:
