13. Insofar as the cases ... absence of any provision in the recruitment policy providing for a
preference to apprentices, or reservation in their favour, no inference can
be drawn

11. In Yogesh Kumar ... this to be followed. It only requires that in
between trained apprentices, preference would be given to
those who are senior.
12. Needless to state
trainees under the Apprenticeship Act are trained that preference should be given to the framed apprentices in the matter of employment. The said instructions ... Grade Iii posts were made from the unskilled workmen in preference to apprentices from May 1979 till October 1982. In terms of the recruitment rules
particular selection and thereafter if an apprentice trainee secured equal marks to the non-apprentice one, preference was required to be given to the apprentice ... apprentice. But wherever such examination or test was prescribed, a trained apprentice had to rub shoulders with the non-apprentice and it is only
standby list will be maintained for the post of Commercial
Apprentice/Traffic Apprentice."
6. The petitioners sought to submit, before the Tribunal, that
Clause ... shortfall in the main panel of
officers selected for the post, prefer the candidates in the standby list.

7. The petitioner was initially appointed as Technical Apprentice in DESU and remained there till
said Act. Aggrieved by this order the petitioner has preferred the present petition under Article 226 of the Constitution and has urged that a writ ... reads as under : "'workman' means any person (including an apprentice) employed in any industry to do any skilled or unskilled manual, supervisory

candidates, preference must be given to the senior candidate
unless, he has shown himself, unfit, provided
employer.
Section 18 . Apprentices are trainees and not workers.-Save as otherwise
provided in this Act,-
(a) every apprentice undergoing apprenticeship training in a designated ... relation to such apprentice.
Section 20 . Settlement of disputes.- (1) Any disagreement or dispute
between an employer and an apprentice arising out of the contract
