4. The applicants also
Perambur and ICF are different establishments. ICF by itself trains Apprentices under the Apprentices Act . The guidelines laid down by the Supreme Court ... done in the past or at least give definite preference to the Apprentices, by shortlisting the candidates for selection. 313 candidates who do not possess
preference is to be administered and has clarified that other classification must be equal and thereafter, the preference is to be given to the Apprentices ... senior to the persons trained later. In between the trained apprentices, preference shall be given to those who are senior.
13. Insofar as the cases
Apprentices in Railway Establishment are only to be given preference over other apprentices and nothing more. The preference only extended when other things are equal ... candidates have got the same merits, the Course Completed Act Apprentice are to be preferred and that does not mean that the such Course Completed
categories of apprentices.
(i) Trade apprentices-either fresh candidate or M
qualified candidates;
(ii) Technician apprentices (Diploma Holders); and
(iii) Graduate Engineer apprentices ... apprentices which are as under:
(i) Trade apprentices-either fresh candidates or ITI
qualified candidates
(ii) Technician apprentices (Diploma Holders); and
(iii) Graduate Engineer apprentices
expressed the desire that "other things being equal
trained apprentices should be given preference in case of
employment.".
10. For a promise ... senior to the persons trained later. ln
between the trained apprentices, preference shall be given to
those who are senior.
19. Similarly this Tribunal while
training, be bound to offer suitable
employment to the Apprentices and the Apprentices shall be bound to
serve the employer in that capacity for such ... Board has rightly formulated its own policy for recruitment of
Apprentices by giving preference to CCAAs to the extent of 20 per
cent
Nigam Shishukhs Berozgar Sangh and Ors. , contending that a trained apprentice should be given preference. Reliance was also placed on Narender Kumar ... senior to the persons trained later. In between the trained apprentices, preference shall be givens to those who are senior.
In the next paragraph
rule is silent on this aspect, relaxation for the period
when the apprentice had undergone training would be given. It was also stated

Learned Counsel for the respondents has further

(1)Other things being equal, a trained apprentice should be given preference over direct recruits.
(2)For this, a trainee would ... senior to the persons trained later. In between the trained apprentices, preference shall be given to those who are senior.
