petitioners were getting the bricks, iron pipe and
asbestos lying in Liwana Church premises kept in their godown. On
receiving the information of the aforesaid ... that the petitioners, who were happened to be Teachers, were taking
asbestos, bricks etc. from the Church and kept the same in godown
possession of ground floor,
entire 2nd floor and six rooms as asbestos roofing on
the 3rd floor in their holding No.9, D. N. Tagore
permanent covering the Sub-Lessee may cover it with tin and/or
asbestos shed.
The petitioners state that they were arraigned as accused
persons
trespassed into the shed of the first
respondent which was covered with Asbestos Sheet and damaged the articles,
which were kept inside the shed. Hence
liters of multi brand
illegal wine has been recovered from the asbestos house of
appellant no. 1 and both appellants were arrested on spot.
Learned
armed with guns and weapons and
destroyed the parking area including the asbestos shades and locked the
gate of petitioner's house and blocked
brick and
stones to his house. As a result of which, the asbestos of the roof
got damaged. They threatened them dire consequence
Petitioners abused
the Informant in obscene languages and damaged the asbestos as
well as the glasses of the house and had stolen some household
articles
Informant protested but the Petitioners abused in
obscene languages the asbestos of their shop by hammer. They also
damaged the inverter and other household articles
