Dilshad Garden, Delhi deposed that on 14.4.2013 the girl was
brought to Sanskar Ashram ... that she was 13 years old. The
school record was verified and seized from the school
authorities vide memo Ex. PW18/A. The present
challan. Certificate from the Primary School was obtained vide
mark B/PW2. Statement of prosecutrix u/s 164 Cr.P.C was got recorded ... which
was seized. Her statement before Magistrate was recorded u/s 164 Cr.P.C,
wherein she stated the same version that she is living
Section 363 / 366 / 376
IPC was filed against the accused and since the offence
under Section 366 IPC and 376 IPC are exclusively triable ... Cr.P.C and there is no explanation from the
prosecution as to why such a statement was not recorded.
