legal and legitimate action, the deceased adopted an escapist
course of committing suicide in order to take revenge from his
alleged tormentor ... though he may be tried for other offences such as
attempt to commit extortion or other offences, if any. In this
background, this Court find
present case is allegedly of extortion and causing
injuries in attempting to commit extortion.
Looking at the facts and circumstances of the case
specially that
threat (as per case of complainant) is not an attempt to commit
extortion as the threat is not imminent. Trial court further observed
that
appellant has
committed the offence of slander is not established from the record.
So far as, the question of extortion is concerned, the evidence
available ... accused did so in order to the committing of extortion.
