granting regular bail, but in this case the
J.J.B. failed to consider the bail petition and passed the
impugned order under appeal ... proceedings, if he is released on bail,
it will defeat the ends of justice and rejected the bail petition of
the juvenile offender.
16. With
taken up the investigation.
(ii)According to P.W.2, bail petition filed by Rama Thiyagaraja Kumar
was dismissed by the Trial Court ... record no
objection for the bail application likely to be filed in future. Admittedly,
no bail petition was pending or filed, after the dismissal
extracted hereunder:
“6.I am aware that Thiru.Divanoli, filed a bail
petition before the Judicial Magistrate, Shenkottai in
CRMP No.6945/2018 ... Shenkottai
Police Station Crime No.403 of 2018 and the bail
petition is yet to be disposed and further, in this case,
he filed another
Again the bail application was filed by the father of
the appellants, but the J.J. Board dismissed the second
successive bail petition ... been very good
and he is entitled for bail and requested to consider bail petition
of petitioner.
19. Further, this Court feels to observe that
during hearing of the bail application. Even
if a ground for grant of bail is not taken in the bail petition and
not argued ... accused on bail on such ground if it is
legally sustainable. Strict rules of pleadings are not applicable in
bail petition.
In view
that the Public Prosecutor (P.W.2) had not opposed the Bail Petition, by raising objections.
3.18.The Learned Counsel for the Petitioner points ... Bail Application was came up for hearing before the Petitioner, already the charge sheet was filed. Moreover, no copy of the Bail Application/Petition
filing of present bail petition,
bail petitioner in the month of August, 2018 had filed bail
petition in the Court learned Special Judge, Solan, which ... justice being
thwarted by grant of bail.
14. Consequently, in view of the above, present bail
petition is allowed. Petitioner is ordered to be enlarged
required
to be recovered from the bail petitioners, as such, bail
petitioners are entitled for grant of bail.
6. On the other hand, Mr. Dinesh ... bail, there is
every possibility that they may influence or tamper with the
evidence adduced on record of investigating agency, as such,
present bail petitions

6. I have perused the grounds urged in the bail
petition, FIR, complaint and other materials placed on
