Supaul has cancelled the Basgit Parcha issued in favour

3. After some argument, learned counsel for the
petitioners seeks permission prefer
case is The Bihar Privileged Persons Homestead
Tenancy Act in which Basgit Parcha has been issued but on the
other hand, he also submits that
private respondents on the other
hand submits that they are the parcha holder from the competent
officer and upon not providing the possession ... hurdle for the present
petitioners are concerned it is basgit parcha, which is the hurdle
for the petitioners under Section 21 of the Bihar Privileged
order dated 02.04.2004 passed by the
Anchal Adhikari, Palasi granting Basgit Parcha to the petitioner
under the Bihar Privileged Persons Homestead Tenancy Act , has
Patna ... that this Rule is mandatory, and prior to the issuance of
Basgit Parcha, Rule 5 must be followed.
8. In this view of the matter
Learned counsel for the petitioners submits that the
petitioners are the basgit parcha holders allotted to them in
between the year 2003-2011, but possession
land which has been granted to him by virtue
of Basgit Parcha in his favour and further to direct the Anchal
Adhikari for the measurement
settlee of the said land by virtue of issuance of
Basgit Parcha in favour of the petitioner under the Bihar
Patna High Court CWJC ... counsel for the petitioner further submits
that the order of issuing Basgit Parcha was challenged by the
private respondents under Section
present writ petition has been filed for setting-
aside the basgit parcha and the said Jamabandi issued in favour
of the private respondents.

petitioner or without issuing any notices to the petitioner, basgit
parcha has been granted in favour of the private respondents.
