Vyas for the petitioner drew my attention
to Rule 41 of the BCSR to contend that whenever the
government servant joins another post maintaining continuity ... opposed the petition
contending that Note 8 below Rule 41 of the BCSR was later on
amended by circular dated 17.06.1994, in which
years
of services with the respondent Corporation and as per
the BCSR Rules and the order passed by the then
Municipal Commissioner of the respondent ... with the
respondent Corporation from 21.11.81 to 28.2.2000 as
well as the BCSR Rules, the Petitioner is not entitled for
any pensionary benefits from

3. Under Rule 250 of the BCSR, it is provided in
Clause (b) that unless Government in any case ... Annexure-A, Note : 4 has been added to Rule
250 of BCSR by notification dated 1st May, 1971
and the said Note 4 reads

compulsorily retired the petitioner by offering three

AGP pointed out that in the case of D.M.Gohil (supra), the very

Rule 161 of Bombay
Civil Service Rules (hereinafter referred to as 'BCSR'
for convenience) and contended that no officer or
servant shall ... against such reduction, removal,
dismissal or punishment. As per Rule 161 of BCSR
before passing an order of compulsory retirement,

reiterate and submit that the provisions of the BCSR Rules are not
applicable to the petitioner for the purpose ... further
deny that Note 1 of Rule 41(ii) of the BCSR Rules would be available to
the petitioner until she reaches the figure
