'below benchmark'. It is an admitted case of the parties that these two
'below benchmark' grading were not communicated ... formalised as under:-
a) That the non-communication of the below benchmark
grading in the ACRs is violative of the principles of natural
justice

considered having below benchmark gradings and therefore, he was not
considered for promotion. According to the petitioner
wherein it
has been held that ACRs with below benchmark
gradings should be communicated to the officer for
his representation. It is submitted that ... with the
consideration of the representation against the below
benchmark grading.
(iv) That apart the Tribunal has also erred in concluding
that the ratio
wherein she had been graded 'Good', a grade
which was below the prescribed benchmark of 'Very Good'. Since there

because below benchmark ACR gradings were never conveyed to the
