paid. As P.W.9 was
not interested in paying the bribe amount, the instant complaint was
filed. Thereafter ... During the trap, the accused-appellant
was caught red handed while taking bribe money of Rs.2000/- from the
complainant and the said
accused was
caught red handed while taking bribe and after completing the
formalities and investigation, charge sheet was submitted.
Accordingly, cognizance was taken and charges ... that mere recovery by itself cannot prove the
charge of demand of bribe against the accused in absence of any
evidence. In view of Section
criminal
case by the Vigilance Department on 08.11.2012 while
accepting bribe of Rs. 5,000/- from Rajesh Dahanga, petitioner
was sent to judicial custody ... found not
satisfactory on account of aforesaid serious charges of having
accepted bribe, contractual engagement was terminated vide
impugned order at Annexure-4 bearing office
parties.
It reveals that petitioner was caught red handed with bribe money of
Rs.10,000/ which he had demanded from informant for handing over ... submits that petitioner was
working as an accountant and he had demanded bribe and he was
apprehended with bribe money.
Considering period of detention
that KCC loans were
sanctioned to the beneficiaries, in which, bribe was taken from the beneficiaries.
Learned counsel for the petitioner has submitted that
support the case of the prosecution but on the point of
giving bribe money, he deviated himself from his earlier statement as he did
depose

framed as the petitioner has never been alleged to have accepted bribe
from anyone, rather as per the case of the prosecution ... wherein a question was asked as to whether he would be accepting bribe if
it is offered by anyone for casting vote for the election

the complainant. The complaint petition has been
trap case in which the petitioner was apprehended while
accepting bribe of Rs.10,000/-.
In the facts of this case, I am inclined
forest guard.
