towards the maintenance charges and other
charges to the builder. The plaintiff has deposited that maintenance
charges with the builder vide ... liable to pay the outstanding
maintenance charges and other charges to the builder or it had paid the
maintenance charges to the builder till

charges/replacement funds/insurance as also such additional charges on
the basis of the actual outgoings as may be billed by the builder ... since when such charges were paid. Plaintiff has merely proved
that water charges were paid upto 31.03.2004 and maintenance etc
charges were paid upto
builder prior to filing of the suit by the association against the
builder. He has further denied that they have claimed the electricity charges from ... maintenance to the builder as services
rendered by the builder was not proper and builder has been charging exorbitant
amount of maintenance from the occupants
defendants that he and his partner shall receive their brokerage charges
from the builder M/s Uppal Housing Pvt. Ltd. @2% being their
regular brokers ... between the builder and
defendants and further that the builder was not only responsible for
making payment of commission or brokerage charges

agreed to pay the maintenance charges and other charges directly to the

6.13 It is denied
plaintiff
shall not be required to pay any maintenance charges to the
Builder/Maintenance Company i.e.the defendant no.3 till the transformer ... Purchasers herein shall not be required to
pay any Maintenance Charges to the
Builder/Maintenance Company till the Transformer (Sub-
station) is installed, and physical
plaintiffs shall not be required
to pay any maintenance charges to the Builder/Maintenance Company i.e.the
defendant no.2 till the transformer ... Purchasers herein shall not be required to pay
any Maintenance Charges to the Builder/Maintenance
Company till the Transformer (Sub-station) is installed,
and physical
scavenging tax, Water
Charges, Fire safety, Fire Fighting Equipment charges,
Electric Meters, Electric Connection or any other
taxes/charges in advance every year, which ... become payable to Builders or
to other Licencee due to such payments shall be
unprejudiced entitlement of the Builders. The Builders
or their authorised representatives
collected those charges from the occupants/appellants did not
deposit the same with DDA.
3.4 Since despite collecting all charges, the builder failed to
maintain ... been regularly depositing the ground rent and all other
charges with the builder and it is the builder who committed default by
not depositing
