safety of others and while doing so, the sixth floor of
building collapsed and caused damage to the nearby buildings and thereby the
accused persons ... constructing the building in question though he used to see
Ahuja and the accused at the site where the building collapsed. It is true that
complete the
construction work and on 04-07-2012 the entire building was
collapsed and the said incident took place due to the faulty design ... Sabanna
went inside the building to drink water and then sound came and
suddenly building collapsed and some children were struck inside and
some persons
other hand submitted that a portion of the subject building had collapsed on 02.12.2017 and therefore, since there was imminent danger that the entire building ... pertinent to bring down the building in view of the incident wherein the portion of the building has collapsed.
6.I have given careful consideration
alia, passed the following order:
“The complaint is filed on the same building
against different accused. There is delay of
near about 2 months ... thereunder that if the repair works are not
carried out, the building would collapse, and the crime
complained was in nature of a continuing offence
building was going on over
there. During the demolition, terrace of the building was broken and some
persons got injured due to the collapse
