thereafter in consequence thereof she became
pregnant and thereafter, he caused miscarriage of her against her will and
that alternatively, during the abovesaid period ... became pregnant and accused gave some medicine to me for
causing miscarriage against my wishes. (Confronted with the
statement Ex. PW9/A, where
application that the plaintiff was pregnant and that the plaintiff caused forcible miscarriage of a child and concealed the birth of that child. The plaintiff ... responsible for it. The plaintiff had absconded with Bapurao who caused miscarriage. This defendant, during the police investigation, spoke these things which were true
victim. It is further mentioned in the FIR that applicant also caused miscarriage of the victim.
4. Learned counsel for the applicant submitted that entire ... submitted that although, there is allegation against the applicant that he caused miscarriage to the victim but no charge-sheet was filed against the applicant
allegation against him is that he and his family
members caused miscarriage of her pregnancy by giving some
medicine in water.
Learned counsel ... petitioner and he forcibly administered
poisonous medicine in luke water causing miscarriage of her
pregnancy. It was further submitted that both parties have entered
into
petitioner and got the same
swallowed by her forcibly and caused miscarriage without her
consent. Thereafter again when she became pregnant in October ... Remo and made her to swallow the

medicine forcibly and caused miscarriage. Basing on the said
complaint, the above crime was registered.

SECTION 313 IPC
"Causing miscarriage without
woman's consent- Whoever commits
the offence defined in the last ... were levelled against the accused
for allegedly causing miscarriage of his wife Smt. Preeti by

the month of February, 2013, he caused miscarriage of the Prosecutrix

complainant and beaten up her sons and daughter in law
causing miscarriage of the daughter in law.

question and the dismissal of the application by
the Magistrate has caused miscarriage of justice to the
appellant.
