11. Section 415 of the Indian Penal Code defines cheating as under :
" Section 415 .--Cheating--Whoever ... reiterate that one of the ingredients of cheating as defined in
Section 415 of the Indian Penal Code is existence of an intention of making
making
initial promise being absent, no offence under Section 420 of the Indian
Penal Code can be said to have been made ... reiterate that one of the ingredients of cheating as defined in
Section 415 of the Indian Penal Code is existence of an intention of making
trust in
respect of such property."
Section 415 of the Indian Penal Code defines cheating as under :
"Section 415.--Cheating--Whoever, by
deceiving ... reiterate that one of the ingredients of cheating as defined in
Section 415 of the Indian Penal Code is existence of an intention of making
demolition of
the said rooms.
8. Section 415 of the Indian Penal Code reads thus :
Section 415 Cheating Whoever, by
deceiving any person, fraudulently ... cheat".
Explanation,A dishonest concealment of facts is
a deception within the meaning of this section.
Section 415 of the Indian Penal Code

Section 156(1) of the Code except under an
order of a Magistrate within the purview of
Section 155(2) of the Code ... main
ingredients for constituting an offence of cheating, as contained in Section
415 of the Indian Penal Code, did not and could not arise
without jurisdiction was a nullity.
27. Section 415 of the Indian Penal Code defines "cheating". The said
provision requires: (i) deception ... held :
"A bare perusal of Section 415 read with
Section 420 of the Indian Penal Code would
clearly lead to the conclusion that fraudulent
which the appellants were not entitled
to, the complainant - respondent had been cheated. It is difficult to accept
the said contention. Appellants had not made ... Cheating' has been defined in Section 415 of the Indian Penal Code
to mean:
"Cheating-- Whoever, by deceiving any person,
fraudulently or dishonestly
made promise therefor.
10. Sections 405 and 415 of the Indian Penal Code defining `criminal breach of trust'
and `cheating' respectively read ... does not constitute an offence of cheating.
11. The ingredients of Section 420 of the Indian Penal Code are :
"(i) Deception of any persons
Indian Penal Code can be said to have been
made out in the instant case.
Section 405 of the Indian Penal Code reads, thus:
Whoever ... said to have been
made out.
Section 415 of the Indian Penal Code defines cheating to mean:
Whoever, by deceiving any person, fraudulently
or dishonestly
made touching
the discharge of such trust."
Ingredients of Section 409 of IPC read as under :
"(i) The accused must ... main
ingredients for constituting an offence of cheating,
as contained in Section 415 of the Indian Penal
Code, did not and could not arise
