In paragraph 10
of the judgment in Muthupandi (supra), the Apex Court clarified
that while the earlier position was that accidental death cases
falling under Section 304A IPC ordinarily warranted imposition
of sentence rather than imposing fine, the latest view
recognizes that in a given set of facts, payment of
compensation may constitute an adequate and just relief.
