M/S S.S. Agro Bio-Tech Flour Mills ... vs Arvind Singh on 4 October, 2024
In the judgment passed by the Hon'ble
Supreme Court in the case of "Vineeta Sharma Vs. Rakesh Sharma
and others" reported in (2020) 9 SCC 1 the appellant before the
Hon'ble Supreme Court was seeking to enforce her coparcenary right
in connection with coparcenary property and the male members of the
family had already created a security interest in favour of secured
creditor on the coparcenary property. The Hon'ble Supreme Court held
that the suit was maintainable seeking enforcement of her coparcenary
right with respect to the coparcenary property irrespective of security
interest having been created in favour of the bank.
