In Bhola Nath Das v. Emperor. AIR 1924 Cal 614 a Division Bench consisting of Greaves and Panton, JJ. of Calcutta High Court took the view that on the expiry of the period of 15 days allowed under Sections 61 and 167 of the Code. the accused person must be released if no cognizance of the offence is taken by a Magistrate on a police report filed under Section 173 of the Code.
