Although the supplementary chargesheet in the present case is filed prior to the judgment, the Hon'ble DHC in aforesaid judgment has disagreed with earlier judgment in Maneesh Goomer v State, 2012 SCC Online Del 66. A clear view has been expressed that aforesaid judgment cannot be considered good law. In view of such a decision, the court finds itself unable to give benefit of previous law to the State. Since, the mandatory procedure was not followed, the accused is entitled to be acquitted.

State vs Anil Kant Nangia on 6 March, 2025

In the present case, although the cognizance was taken way back on 07.05.2018, on which date judgment of Hon'ble High Court of Delhi in Maneesh Goomer (supra) was applicable as per which cognizance can be taken on charge sheet in offences u/s 174 A IPC, the two recent judgments of Hon'ble High Court of Delhi in Amandeep Gill (supra) and Jaswinder Singh (supra) would rule the law now, as per which cognizance can not be taken on the basis of charge sheet.
