7. In the meanwhile, questioning the correctness of the order
passed by learned Single Judge, the State of Bihar filed an appeal
before the Division Bench of the High Court. By the order impugned
before us, the Division Bench allowed the writ appeal by following the
decision in State of Bihar v. Madhu Kumari1. The appellant filed the
Special Leave Petition and by an order dated 6.11.2017, this Court
issued notice and since then, this matter has been pending
consideration.
