In support of his contention,
learned counsel has relied on two unreported judgments of High
Court of Judicature at Patna; Baleshwar Prasad Vs. the State of Bihar
and others passed on 17.06.2014 in Criminal Revision no. 417 of 2014
and another unreported judgment; Ramsevak Yadav Vs. the State of
Bihar and others passed on 18.06.2013 in Criminal Miscellaneous
Case no. 14509 of 2011 wherein a petition was filed for summoning
the accused persons in exercise of power under Section 319 of the
Code, the Juvenile Justice Board, Saran at Chhapra rejected the

prayer vide order dated 03.09.2013 holding that the Juvenile Justice
Board cannot pass any order against the major person, who has never
been made accused and the said order was affirmed by the Hon'ble
High Court. Hence, the order impugned deserves to be set aside.
